Remember that September 30 is the deadline for the EEO-1 report. This report captures confidential workforce data from employers with more than 100 employees (lower thresholds apply to federal contractors, see below), which is then used by both the EEOC for analysis of employment patterns, as well as the OFCCP to determine which employers to select for compliance evaluations.  Employers meeting the reporting thresholds have a legal obligation to provide the data; it is not voluntary.  Here’s are a few FAQ about the EEO-1 report (taken directly from the EEOC).

Q: What is the EEO-1 Report?
A:
The EEO-1 Report – formally known as the "Employer Information Report" – is a government form requiring many employers to provide a count of their employees by job category and then by ethnicity, race and gender. The EEO-1 report is submitted to  both the EEOC and the Department of Labor, Office of Federal Contract Compliance Programs (OFCCP).

Q: Who must file the EEO-1 report?
A:
The EEO-1 report must be filed by:
Employers with federal government contracts of $50,000 or more and 50 or more employees; and
Employers who do not have a federal government contract but have 100 or more employees

Q: When must the EEO-1 report be filed?
A:
The EEO-1 report must be filed annually with the EEOC by September 30. It must use employment numbers from any pay period in July through September of that year.
